Educating Offenders on the Consequences of DUI Negligence

In the summer of 2002, 17-year-old Jamie Maier was backing out of a driveway when a drunk driver, going 100 in a 30 mile-per-hour speed zone, rammed into her car, killing Maier and the passenger. The driver, who had several previous arrests for driving under the influence (DUI), is serving a long jail sentence for two counts of manslaughter. Roseanne Maier, Jamie’s mother, is doing what she can to prevent tragic accidents like this from happening again.

Maier has become a regular speaker at Victim Impact Panels sponsored by Mothers Against Drunk Driving (MADD). Her audience is made up of people arrested for misdemeanor DUI offenses. She speaks candidly about how her daughter’s accident affected their family. MADD wants to make sure everyone caught driving while impaired understands the potentially devastating consequences of this reckless behavior. Hearing from people who have been seriously injured or disabled because of a DUI accident or who are still grieving for loved ones can be a more effective wake-up call than having a license suspended or paying a fine.

Arizona had one of the worst DUI problems in the country in the 1970s and 1980s. Recognizing the urgent need for change, Stan Marks of Begam & Marks, helped found the Arizona Chapter of MADD As the organizations founding board chairman, Mr. Marks and MADD set out to educate the public, lobby the legislature for tougher law, and push for zero tolerance enforcement.

Now, Arizona has the toughest laws in the country. Recent statistics show that there were over 30,000 DUI arrests in 2012.

Arizona ranks seventh in number of DUI arrests per capita compared to other states. Despite these efforts, however, much still needs to be done. Even as recently as 2011, 26 percent of traffic fatalities in 2011 involved a DUI driver.
